New Data Availability System

A new Data Availability System is being developed by ECHA. To begin with this system will take over the responsibility of making REACH registration data available, once it is ready. We expect the first version to be publicly available by the end of 2023.

Since ECHA aims to devote our maximum effort to this new system, we can no longer maintain REACH registration data on the current Dissemination Platform. As such once the IUCLID format change begins on 19th May 2023 we will no longer update REACH registered substance factsheets. The factsheets will remain online, but will not be updated.

As a consequence, REACH registration data will likewise not be updated in Infocards, Brief Profiles, the Advanced search, or the Nanomaterials on the EU market portal. We will inform you of what you can expect in the new system, along with details of when and where to find it.

Hawnhekk tista’ tfittex nanomaterjali li bħalissa jinsabu fis-suq tal-Unjoni Ewropea (UE). Ir-riżultati ta’ dan it-tiftix jinkisbu mill-bażi tad-data pubblika dwar is-sustanzi kimiċi tal-Aġenzija Ewropea għas-Sustanzi Kimiċi (ECHA); u r-riżultati jinkludu wkoll data rkuprata u pproċessata minn diversi sorsi ta’ data esterni, kif deskritt hawn taħt.

 

Id-data murija dwar in-nanomaterjali hija miġbura minn sorsi disponibbli għall-pubbliku
  • Reġistrazzjonijiet ta’ REACH: Mill-1 ta’ Jannar 2020, ir-Regolament (KE) Nru 1907/2006 (ir-Regolament REACH) jirrikjedi li l-kumpaniji kkonċernati jippreżentaw data dwar in-nanoforom ta’ sustanzi bħala parti minn dossier ta’ reġistrazzjoni ta’ REACH (skont ir-Regolament tal-Kummissjoni (UE) 2018/1881 tat-3 ta’ Diċembru 2018 li jemenda r-Regolament (KE) Nru 1907/2006). It-tiftix jirkupra reġistrazzjonijiet mill-bażi tad-data dwar is-sustanzi kimiċi tal-ECHA li tinkludi mill-inqas nanoforma waħda.
  • Inventarju nazzjonali Franċiż: Fl-2013, Franza stabbiliet rekwiżit li n-nanomaterjali fis-suq Franċiż jeħtieġ li jiġu nnotifikati. In-notifiki jeħtieġ li jiġu aġġornati mill-kumpaniji jew mil-laboratorji pubbliċi fuq bażi annwali. Id-definizzjoni ta’ nanomaterjal għall-iskema Franċiża hija derivata mir-rakkomandazzjoni tal-Kummissjoni Ewropea għad-definizzjoni ta’ nanomaterjal, u l-limitu għan-notifika huwa ta’ 100 gramma, jiġifieri, taħt il-limitu ta’ tunnellata/sena li jkun jirrikjedi reġistrazzjoni skont ir-Regolament REACH. Innota li t-tunnellati rrappurtati fl-inventarju Franċiż jirriflettu biss it-tunnellaġġ tan-nanomaterjal, filwaqt li r-regolament REACH huwa bbażat fuq it-tunnellaġġ totali tas-sustanza importata jew prodotta fis-suq tal-UE, inklużi kemm in-non-nanoforom kif ukoll in-nanoforom tas-sustanza.
  • Inventarju nazzjonali Belġjan: Fil-Belġju, fl-2016 daħal fis-seħħ rekwiżit nazzjonali li jiġu ppreżentati notifiki dwar in-nanomaterjali. Ir-rekwiżit ikopri sustanzi prodotti fi stat nanopartikolari u mqiegħda fis-suq Belġjan ta’ aktar minn 100 gramma fis-sena. Id-definizzjoni ta’ nanomaterjal għall-iskema Belġjana hija kważi identika għal dik tar-rakkomandazzjoni tal-Kummissjoni Ewropea għad-definizzjoni ta’ nanomaterjal. Innota li l-inventarju Belġjan jeskludi sustanzi naturali, mhux modifikati kimikament, u sustanzi li fihom il-partikoli tan-nanomaterjal jitqiesu bħala prodott sekondarju tal-attività tal-bniedem. B’mod konkret, l-inventarju Belġjan jirrikjedi r-reġistrazzjoni ta’ sustanzi u taħlitiet li fihom in-nanomaterjali. Barra minn hekk, artikli u oġġetti kumplessi li fihom nanomaterjal wieħed jew aktar jeħtieġ li jiġu nnotifikati - għalkemm id-dħul fis-seħħ tan-notifika ta’ artikli u oġġetti kumplessi għadu ma daħalx fis-seħħ. Hemm diversi eżenzjonijiet fis-seħħ, bħal dawk għall-pigmenti, il-kożmetiċi u l-prodotti bijoċidali. Il-kumpaniji iridu jaġġornaw l-informazzjoni tagħhom fuq bażi annwali.
  • Inventarju tal-kożmetiċi tal-UE: Ir-Regolament KE 1223/2009 għandu regoli speċifiċi dwar l-użu ta’ nanomaterjali fi prodotti kożmetiċi, għalkemm ma jużax ir-rakkomandazzjoni tal-Kummissjoni Ewropea għad-definizzjoni ta’ nanomaterjal. In-nanomaterjali huma definiti bħala “materjal insolubbli jew bijopersistenti u manifatturat intenzjonalment b’dimensjoni esterna waħda jew aktar, jew struttura interna, fuq skala minn 1 sa 100 nm”. Awtorizzazzjoni bil-quddiem qabel l-użu tagħhom fi prodotti kożmetiċi hija meħtieġa għal prodotti bħal sustanzi koloranti, preservattivi u filtri tal-UV. Il-Kummissjoni Ewropea tippubblika katalgu ta’ prodotti kożmetiċi li jużaw in-nanomaterjali, u taġġornah regolarment abbażi ta’ data ppreżentata permezz tal-Portal ta’ Notifika tal-Prodotti Kożmetiċi (CPNP).

Minħabba d-differenzi fid-definizzjoni tan-nanomaterjali, l-eżistenza ta’ eżenzjonijiet speċifiċi, u l-limiti ta’ rappurtar tat-tunnellaġġ, il-preżenza ta’ nanomaterjal fi kwalunkwe wieħed minn dawn is-sorsi ta’ data ma jfissirx li huwa preżenti fihom kollha. In-nanomaterjali notifikati lill-inventarji Franċiżi jew Belġjani, jew permezz tal-Portal ta’ Notifika tal-Prodotti Kożmetiċi, ma jfissirx awtomatikament li s-sustanza trid tiġi rreġistrata bħala nanoforma skont ir-Regolament REACH u viċeversa.

Peress li s-sorsi li jikkontribwixxu għandhom regoli u ambiti ta’ rappurtar differenti, mhux dejjem huwa possibbli li titqabbel sustanza rrappurtata f’wieħed mis-sorsi ta’ data mas-sustanza fil-bażi tad-data tas-sustanzi kimiċi tal-ECHA. Meta l-ebda tqabbil ma jkun possibbli, is-sustanza fis-sors oriġinali ma tiġix irrappurtata fl-għodda tat-tiftix tal-EUON għan-nanomaterjali. Il-kumpaniji li jinnotifikaw in-nanomaterjali lill-inventarji nazzjonali Franċiżi u Belġjani jistgħu jkunu wkoll differenti minn dawk li għandhom obbligi ta’ reġistrazzjoni skont ir-Regolament REACH.

F’ħafna każijiet, sustanza tista’ tiġi manifatturata jew bħala nanoforma jew bħala non-nanoforma. Għalhekk, huwa possibbli li sustanza partikolari tiġi nnotifikata bħala nanoforma minn kumpanija waħda, iżda mhux manifatturata f’nanoforom minn kumpaniji oħra. Dawn id-differenzi jistgħu jirriżultaw f’sustanza li tidher bħala nanoforma f’sors wieħed, iżda mhux f’oħrajn.

Xi wħud mill-informazzjoni rkuprata mill-għodda tan-nanomaterjali jaf tappartjeni għal partijiet terzi. L-użu ta’ tali informazzjoni jaf għaldaqstant jirrikjedi l-permess minn qabel tad-detenturi tad-drittijiet. L-Aġenzija Ewropea għas-Sustanzi Kimiċi u l-Kummissjoni Ewropea ma jagħtu l-ebda garanzija jew pleġġ fir-rigward tal-kwalità, l-użu u/jew l-idoneità tal-informazzjoni. L-użu tal-informazzjoni jibqa’ taħt ir-responsabbiltà unika tal-utent.
